AllPartyRental.com Vendor Agreement

1. Introduction

These Provider Terms & Conditions ("Agreement") govern your participation as a Vendor ("Provider," "you," or "your") on AllPartyRental.com ("Platform," "Company," "we," or "us").

By creating a Provider account, listing equipment, or accepting bookings, you agree to this Agreement.

2. Independent Contractor Status

AllPartyRental.com is a marketplace platform only. Providers are independent businesses and not employees, partners, or agents of the Company.

The Provider is solely responsible for:

• Equipment ownership

• Delivery, setup, and pickup

• Staff hiring and training

• Tax reporting and payments

• Insurance and permits

• Business compliance with local laws

3. Provider Responsibilities

Provider agrees to:

3.1 Equipment Quality & Safety

• Supply clean, safe, and fully functional equipment

• Follow manufacturer safety guidelines

• Replace damaged or unsafe items immediately

• Ensure inflatables have proper stakes, sandbags, and blowers

• Provide mats, barriers, or supervision if required

3.2 Accuracy of Listings

• Provide true and accurate photos

• Provide correct pricing, descriptions, and availability

• Keep schedule/calendar updated

• Respond to customer messages promptly

3.3 Delivery & Setup

• Arrive on time

• Deliver and set up equipment safely

• Follow customer location instructions

• Remove and clean up equipment after event

3.4 Legal & Insurance

Provider must comply with:

• Local city and state rental laws

• Zoning & park rules

• Liability insurance (if required in your area)

• Any permits or bounce-house regulations

Provider is fully responsible for injuries, incidents, or equipment damage.

4. Marketplace Fees

The Platform may charge:

• Vendor commission fee

• Service fees

• Payment processing fees

These fees may change with notice.

5. Payment Terms

• Customers pay through our payment processor (Stripe/PayPal).

• Providers receive payouts after the event, minus fees.

• Fraud, chargebacks, or disputes may delay or affect payouts.

• Provider must supply accurate bank account or Stripe/PayPal information.

6. Cancellations & Refunds

Providers must honor the cancellation policy selected in their listing.

If the Provider cancels a confirmed booking:

• Customer receives full refund

• Provider may be penalized or suspended

• Repeated cancellations may result in removal from Platform

Weather-related cancellations follow the Provider's chosen policy.

7. Customer Communication

Providers agree to:

• Communicate professionally

• Not exchange threats, harassment, or inappropriate content

• Not divert customers away from the Platform to avoid fees

• Not negotiate off-platform pricing or payments

Doing so may result in account termination.

8. Damage, Loss, & Cleaning Fees

Provider may charge customers for:

• Damage caused by misuse

• Missing pieces or lost equipment

• Excessive dirt, food, liquids, or waste

• Unsanitary or biohazard conditions

Provider must document damage with photos and clear proof.

9. Provider Liability

Provider is fully liable for:

• Injuries, accidents, or unsafe setups

• Equipment malfunction

• Staff behavior or mistakes

• Property damage at customer location

• Legal compliance and insurance

AllPartyRental.com is not liable for Provider actions.

10. Disputes With Customers

Steps:

• Provider and customer must attempt to resolve directly

• If unresolved, contact Platform support

• Platform may help mediate but is not the final decision-maker

• Provider must supply photos, videos, or proof when requested.

11. Account Suspension & Termination

We may suspend or remove Providers for:

• Unsafe equipment

• Repeated customer complaints

• Fraud, chargebacks, off-platform payments

• Inaccurate listings

• Disrespectful or abusive behavior

• Violating Platform Terms

Termination is at our discretion.

12. Prohibited Provider Activity

Providers may not:

• List fake or inaccurate items

• Book their own listings to fake reviews

• Use bots or create multiple accounts

• Circumvent Platform fees

• Post copyrighted photos they do not own

• Deliver unsafe or unlicensed equipment

13. Taxes

Provider is responsible for:

• Sales tax (if required in location)

• Self-employment taxes

• Business tax filings

• Local municipal rental taxes

The Platform does not file taxes for Providers.

14. Privacy & Data

Provider agrees to:

• Allow us to collect necessary business data

• Allow communication with customers via Platform

• Not misuse customer phone numbers or emails

Customer data may only be used for fulfilling the booking.

15. Modifications to Terms

We may update this Agreement at any time. Continued use of the Platform means you accept the new terms.

16. Governing Law

These terms are governed by the laws of the State of New York, USA.
